VİMOZA.COM DOPING ADVERTISING SPACES CANCELLATION AND REFUND AGREEMENT

Vimoza.com is an e-commerce platform managed by CMR Danışmanlık ve Teknoloji Ltd. Şti. ("Company"), allowing individual and corporate users to add doping advertising spaces to their listings. This Cancellation and Refund Agreement ("Agreement") governs the cancellation and refund rights of users who purchase doping advertising services on the Vimoza.com platform.

Customer:
Individual or corporate user registered on the Vimoza.com platform who has purchased a doping advertising service.

2. Subject of the Agreement

This Agreement regulates the cancellation and refund processes for doping advertising services purchased on the Vimoza.com platform. The Customer may request a cancellation or refund from the Company under the conditions specified in this Agreement.

3. Doping Services

The following doping advertising services are subject to the cancellation and refund rules:

  • Bold Text & Colored Frame: Emphasizing the listing title with bold text and adding a colored frame.
  • Urgent: Highlighting the listing as "Urgent" to increase its visibility.
  • Category Showcase: Displaying the listing in the showcase area of the selected category.
  • Homepage Showcase: Featuring the listing in the showcase area on the platform’s homepage.

4. Cancellation and Refund Conditions

4.1. Cancellation Right: The Customer may request a cancellation after payment is made but before the service is activated. Once the service is activated, the right to cancel is forfeited.

4.2. Right of Withdrawal: According to the Regulation on Distance Contracts, the Customer has the right to withdraw within 14 days. However, if the service has started within the withdrawal period, the right to withdraw is no longer applicable.

4.3. Refund Conditions: If the service is canceled before activation upon the Customer's request, a full refund will be provided. Once the service has started, no cancellation or refund is possible.

4.4. Technical Issues: In case of technical issues that prevent the delivery of the doping service, the Company is obligated to resolve the problem. If the issue cannot be resolved, the service period will be extended, or a refund will be provided.

5. Cancellation and Refund Process

5.1. Cancellation Request: If the Customer wishes to cancel the service before activation, they must send a written request to [Enter Email Address]. The request will be reviewed by the Company, and if the service has not been activated, the cancellation will be processed.

5.2. Refund Process: Refunds will be processed using the same payment method used by the Customer. The refund process may take 7-14 business days, depending on interbank operations.

5.3. Cancellation and Refund Approval: The Company will inform the Customer of the approval of their cancellation and refund request after evaluation. If the request meets the refund conditions, the refund process will be initiated.

6. Company's Rights to Cancel Service

6.1. Violation of Platform Rules: If the Customer violates the terms and conditions of use on the Vimoza.com platform, the Company may suspend or cancel the doping service. In such cases, no refund will be issued.

6.2. Misleading or Inaccurate Listings: If a listing contains misleading information or violates platform rules, even if the doping service has been applied, the Company may remove the listing and terminate the service. No refund will be provided.

7. Exceptions to the Right of Withdrawal

The Customer's right of withdrawal does not apply in the following cases:

7.1. Used Service: Once the doping service is activated on the Customer's listing, the right of withdrawal is no longer valid.

7.2. Digital Content: Since the service is provided as digital content, once the delivery of the service has started, the Customer cannot exercise the right of withdrawal.

8. Limitation of Liability

8.1. Platform Violations: The Company does not accept liability for doping services used in violation of Vimoza.com usage terms or applicable laws. The Customer is responsible for ensuring that their listings and content comply with platform rules.

8.2. Technical Issues: The Company will take necessary steps to address technical issues affecting service delivery. However, the Company is not liable for indirect losses caused by technical problems.

9. Privacy and Personal Data Protection

9.1. Data Processing: The Company will process the Customer's personal data solely for the purpose of providing the service and in compliance with the Personal Data Protection Law No. 6698.

9.2. Data Sharing: The Customer's personal data will not be shared with third parties except as required by law and will only be used for service delivery purposes.

10. Dispute Resolution

Turkish laws shall govern any disputes arising from this Agreement, and [City] Courts and Enforcement Offices shall have jurisdiction for dispute resolution.

11. Validity

This Agreement takes effect upon the Customer's purchase of a doping advertising service on Vimoza.com. By purchasing the service, the Customer is deemed to have accepted the terms of this Agreement.
