VİMOZA.COM DOPING ADVERTISING SERVICES DISTANCE SALES AGREEMENT

("Company") where individual users and corporate firms can publish their product and service listings. This Distance Sales Agreement ("Agreement") is made between the users ("Customer") who purchase doping advertising services to highlight their listings on the Vimoza.com platform and the Company.

2. Definitions

  • Platform: The e-commerce platform on Vimoza.com where individual and corporate listings are displayed.
  • Doping Advertising: Additional services purchased by the Customer to increase the visibility of their listings. Types of doping include:
    • Bold Text & Colored Frame: Emphasizing the listing title with bold text and a colored frame.
    • Urgent: Highlighting the listing as "Urgent" to attract more attention.
    • Category Showcase: Displaying the listing in the showcase area of the relevant category page.
    • Homepage Showcase: Featuring the listing in the showcase area on the platform’s homepage.

3. Subject of the Agreement

This Agreement regulates the terms and conditions related to the purchase of doping advertising services by the Customer on Vimoza.com. Under this Agreement, the Customer purchases various doping features from the Company to highlight their listings.

4. Scope of Doping Services

4.1. Bold Text & Colored Frame: The listing title is highlighted with bold text, and a colored frame is added to make it visually striking.

4.2. Urgent: The term "Urgent" is added to the listing to create a sense of urgency, increasing its visibility.

4.3. Category Showcase: The Customer’s listing is featured in the showcase section of the selected category for a specific period.

4.4. Homepage Showcase: The Customer’s listing is displayed in the showcase area on the homepage of the platform for a certain period.

5. Use of Doping Services

5.1. Service Duration: Each doping service will be valid for a specific period for the selected listing. The duration and price of the service will be communicated to the Customer before the purchase.

5.2. Service Activation: The doping service will be activated immediately after the purchase is completed or once the listing becomes active. The service period begins from this activation point.

5.3. Cancellation and Refund: Purchased doping services cannot be canceled or refunded once they have started. However, the Company commits to resolving any technical issues that may occur.

6. Fees and Payment

6.1. Fee: The fees for doping services may vary based on the type and duration of the service. The fees are calculated according to the current rates listed on Vimoza.com.

6.2. Payment Methods: The Customer can purchase doping services using credit cards, bank transfers, or other online payment methods. The doping service will not be activated until the payment is completed.

6.3. Taxation: Purchased doping services will be taxed according to applicable regulations, including VAT.

7. Company Rights and Obligations

7.1. Service Provision: The Company is responsible for activating the doping services purchased by the Customer on the platform. Service interruptions will not occur except in cases of technical issues or force majeure.

7.2. Content Monitoring: The Company reserves the right to monitor and check whether listings that receive doping services comply with the platform’s rules. Listings that violate platform rules may be removed even if the doping service is active.

7.3. Technical Issues: The Company is responsible for resolving any technical issues on the platform as quickly as possible. If the doping service cannot be provided due to technical reasons, the Company will either extend the service duration or provide a refund.

8. Customer Rights and Obligations

8.1. Providing Accurate Information: The Customer is responsible for providing accurate and up-to-date information when purchasing doping services. Misleading information may lead to the cancellation of the service.

8.2. Compliance with Platform Rules: The Customer must comply with the platform’s general rules in listings that receive doping services. Doping services will not be provided for listings that violate these rules, and no refund will be given.

8.3. Use of Services: The Customer can use the purchased doping service only for the specified listings. The service cannot be transferred to another listing or account.

9. Right of Withdrawal

9.1. Withdrawal Period: The Customer may cancel the purchase of services within 14 days under the right of withdrawal specified in distance contracts. However, the right of withdrawal ends once the doping service is activated.

9.2. Exercise of Withdrawal Right: The right of withdrawal can be exercised by submitting a written request to the Company. If the service has not been activated, a refund will be issued upon withdrawal.

10. Termination and Cancellation

10.1. Termination by Company: The Company may suspend or cancel the doping service if the Customer violates this Agreement or breaches the platform rules.

10.2. Termination by Customer: The Customer may cancel the service and request a refund before the doping service begins. Once the service starts, termination and refund rights are no longer applicable.

11. Limitation of Liability

11.1. Company Liability: The Company is not responsible for any direct or indirect commercial results that the Customer may achieve through doping services. Doping services aim solely to increase the visibility of listings and do not guarantee sales.

11.2. Force Majeure: The Company shall not be held liable for service interruptions due to force majeure events such as natural disasters, internet outages, or technical problems. The service period may be extended once the force majeure condition has been resolved.

12. Privacy and Data Protection

12.1. Protection of Personal Data: The Customer's personal data provided on the platform will be processed and stored in compliance with the Personal Data Protection Law No. 6698. The Company will use customer data solely for service provision.

12.2. Sharing with Third Parties: Customer data will not be shared with third parties except as required by law.

13. Dispute Resolution

In the event of any dispute arising from this Agreement, the laws of the Republic of Turkey shall apply, and the [City] Courts and Enforcement Offices shall have jurisdiction.

14. Validity and Acceptance

This Agreement comes into effect upon the Customer's purchase of doping services. By purchasing the service, the Customer is deemed to have accepted the terms of this Agreement.
